T.I. and Wife Tiny Harris Seek Dismissal of 2005 Sexual Assault Case Filed by Air Force Veteran

Clifford Joseph Harris Jr. popularly known as T.I. and his wife Tiny Harris have filed for a dismissal of a sexual assault lawsuit lodged against them by Jane Doe last month. The couple seeks to have the lawsuit dismissed “in its entirety,” on grounds that the statute of limitations has expired.
Jane Doe, an Air Force veteran, accuses T.I. and Wife, Tiny Harris of having sexually assaulted her, she says that it happened in 2005 in one of the hotel rooms. She met this couple at some nightclub in Los Angeles prior to any alleged abuse taking place. After meeting up with these two at the same club, Doe alleges that they drugged her, took her to their hotel room, and raped her.
Details of the Complaint
The complaint details how Doe leveled serious charges against T.I. and Tiny Harris. One thing about Doe is she served as an air force officer while this ordeal began at a club in Los Angeles in 2005. Doe said that while she was not aware, T.I and Tiny gave her drugs which led to being taken back into their lodge where she was raped . It is pertinent to note here that since Doe’s claims are barred by the law regarding statutes of limitations, there cannot be any legitimacy attributed thereto hence warranting dismissal.
As per documents obtained on Thursday June 27th , rapper T.I ( real name Clifford Harris) 43 years old & R&B singer Tiny Harris ( real name Tameka Harris) 48 years old have filed for dismissal of sexual assault lawsuit according to documents released as of recent. The motion has been submitted before a federal judge located in California which prays for dismissing this case “in its entirety with prejudice” based on Jane Does’ “time barred” claims because it exceeded statute of limitation.

In their legal filing, defendants argue that plaintiff fails to state sufficient facts showing each claim’s validity in her complaint. They stress that the lawsuit should have been filed on December 31, 2007 when considering the allegations at hand. Consequently, this timeline is marked by the incident date provided for in the complaint; however, the present case was commenced over sixteen years after such statutory time elapses, making it barred by time.
Expiration of Statute of Limitations
The motion clearly states, “Here, at best, Plaintiff had up to December 31, 2007, to file the instant lawsuit based on the facts alleged in the Complaint.” In other words, this implies that she could only sue within a given timeframe which ended at some point in 2007. However, since this case was instituted eighteen years later and after what happened as per defendants’ argument therein,—it is time barred and must be dismissed with any claims contained therein.
The defendants’ filing argues further that nothing can resuscitate actionable claims by the plaintiff in relation to the 2005 encounter as described in her complaint. They also contend that there is a lack of factual details that would back up the allegations against them. The submission reads, “It is impossible for any facts at all to save or bring about any cause of action by Plaintiff against Defendants based on the 2005 encounter alleged in the Complaint.” This suggests their position that the lawsuit lacks merit because it has expired and failed to provide enough information.
Under California’s Sexual Abuse and Cover Up Accountability Act, Jane Doe filed a suit on Tuesday, January 2nd. It extends statute of limitations for sex abuse and assault victims through December 2026. In her lawsuit, Doe stated she “did not consent to any of the sexual assault or misconduct” she supposedly experienced during an incident involving T.I. and Tiny Harris in 2005.
Alleged Incident Details
The lawsuit filing tells the entire story of the alleged incident at length. At that time, Doe was in her early 20s and served in the Air Force of the United States. During her stay in Los Angeles, she met rapper T.I. and singer Tiny Harris. According to Doe, a man named Caviar introduced her to these people while she was at a VIP section of a club.
Doe alleges that while still in the club Tiny offered her a drink. She states that after drinking it, Tiny Harris accompanied with T.I and two other women took her to a hotel room. When they got into the hotel room, Doe alleges that Tiny removed her clothes which made her “shocked and uncomfortable to the extreme.” It is said by Doe that then they joined her into shower hence adding on to this problem.
Afterwards, Doe claims that she was signaled by someone called ‘Tiny’ to join T.I on his bed. In this period, she felt so dizzy and lightheaded leading her to conclude beyond reasonable doubt that whatever she consumed was spiked with drugs. As far as Doe is concerned, such feelings together with what went down were enough proof that both men drugged and raped her.

Accordingly during the supposed incident there was one particular moment which was abhorrent as depicted by Jane’s complaint against TiP ( T.I. is also known as TiP). Over Jane’s back allegedly sat Tiny Harris “pinning” or holding down on top of Jane from doing whatever she wanted freely. While still being restrained, T.I according to Doe however put his toes into my vagina but I tried pushing him off me trying to slide him out of me.
Further Alleged Misconduct
Further allegations contained within court documents are also there regarding assault continuing after T.I left for condom retrieval purposes only. While he was away from their location however, Tiny Harris reportedly kept grinding herself against Jane while continuing to massage her buttocks. For this reason, Doe felt increasingly sick. In a lot of pain, both physically and emotionally, Doe ended up throwing up because she overgrew sicker and very ill from the assault as well as battery.
The next morning, Jane Doe says she woke up on the couch feeling “naked, dazed, sickened and weak.” She also states that her vagina was “extremely sore” while she experienced “itching and burning.” All these are symptoms of what happened to her overnight as stated in the lawsuit which include night traumas.
In alleged 2005 attack Doe is seeking unspecified damages over numerous grave charges levied against T.I. She alleges sexual battery, battery, sexual assault, negligence, false imprisonment and intentional infliction of emotional distress. The trauma caused by the incident has seriously affected Jane’s life causing problems with daily activities functioning normally and diminishing her overall happiness according to Doe.
T.I. and Tiny’s Firm Denial of Allegations
The firm denial of any wrongdoing by T.I and Tiny Harris was featured in a joint statement that was acquired in January. They addressed the allegations directly, stating, “Negativity always has a way of rearing its ugly head at the most positive moments. This plaintiff for the past THREE years has been saying she will file this lawsuit. For three years we have vehemently and absolutely denied these claims.”
The statement also continued to maintain their position over time as well. “For THREE years we have maintained our innocence and refused to pay these extortionate demands for things we didn’t do. For THREE years, we’ve maintained the same position while the claims in this story have changed time and time again.” Our stance is clear…We are not guilty of these false charges; we won’t be extorted, and we are awaiting our day before a judge.”
A hearing on T.I and Tiny’s dismissal request is scheduled to take place on Wednesday, August 7th, in Los Angeles thus continuing with legal process. At this hearing, the couple will be specifically addressing their motion to dismiss the entire lawsuit “with prejudice.” It follows from this that since Jane Doe’s claims are barred by statutes of limitation, it makes this case legally unsustainable anymore according to them.
